Moncton Inflate-A-Palooza Terms and Conditions for Event Participants
By purchasing a ticket and attending this event, you acknowledge that you have read, understood, and agree to these Terms and Conditions. These Terms and Conditions govern your participation in or attendance at the Moncton Inflate – A – Palooza (hereinafter referred to as the “Event”).
1. Acceptance of Terms
1.1 By purchasing a ticket, accessing the Event venue, or participating in any Event-related activities, you (“Participant”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including but not limited to the Indemnity and Hold Harmless Agreement, the Assumption of Risk, and the Waiver of Liability outlined herein.
1.2 Binding Agreement: Your acceptance of these Terms is a binding agreement between you and the Organizer. This acceptance occurs upon:
1.2.1. Completing your ticket purchase through any authorized channel (online, in-person, or through a third party).
1.2.2. Checking any required acknowledgment box during the ticket purchase process; or
1.2.3. Entering the Event premises or participating in any Event activities.
1.3 Digital Agreement: If tickets are purchased online or via a digital platform, clicking “I Agree,” “Accept,” or similar confirmation buttons during checkout constitutes your electronic signature, which carries the same legal weight as a physical signature.
1.4 Acceptance on Behalf of Others: If you are purchasing tickets for others (e.g., minors, family members, or a group), you confirm that:
1.4.1 You have full legal authority to accept these Terms and Conditions on their behalf;
1.4.2 You will ensure that all individuals in your group, including minors under your supervision, comply with these Terms and any additional safety guidelines or instructions.
1.5 Additional Acknowledgment: By entering the Event premises or participating in activities, you reaffirm your acceptance of these Terms and Conditions, including any updated or revised terms that may be posted at the Event venue or communicated by the Organizer prior to or during the Event.
1.6 No Participation Without Acceptance: If you do not agree to these Terms and Conditions, you are not authorized to purchase tickets, enter the Event, or participate in any Event-related activities.
1.7 Amendments to Terms: The Organizer reserves the right to modify these Terms and Conditions at any time. It is your responsibility to review the Terms prior to attending the Event. Continued participation in the Event following any updates constitutes acceptance of the revised Terms.
1.8 Acknowledgment of Risk and Waiver: As part of accepting these Terms, you specifically acknowledge that participation in the Event involves inherent risks, and you voluntarily accept and assume full responsibility for those risks on behalf of yourself and any dependents or minors under your care.
1.9 Opt-In for Legal Notices: By agreeing to these Terms, you consent to receive any legal notices, updates to terms, or related communications electronically via the contact details provided.
2. Assumption of Risk and Liability Waiver
2.1 Acknowledgment of Risks: By attending the Event and participating in any activities (including, but not limited to, bouncy rides, games, and other attractions), you (“Participant”) acknowledge and agree that such participation involves inherent risks, both known and unknown, including but not limited to:
- Physical injuries such as cuts, bruises, sprains, fractures, or more serious injuries, including paralysis or death;
- Illness or infections, including those resulting from contact with other participants, equipment, or environmental factors;
- Damage to or loss of personal property;
- Psychological or emotional distress caused by participation in high-energy or competitive activities;
- Exposure to environmental hazards, such as heat, cold, weather conditions, uneven terrain, or obstacles;
- Risks arising from equipment failure, misuse, or malfunction, whether provided by the Organizer or brought by participants.
You further acknowledge that these risks may arise from your own actions or inactions, the actions or inactions of others (including Event staff, volunteers, or other participants), or conditions of the Event venue or equipment.
2.2 Voluntary Assumption of Risks: You voluntarily and knowingly assume all risks, both inherent and incidental, associated with attending the Event and participating in its activities, regardless of the cause or nature of the risks, including risks that may result from the negligence of the Organizer or third parties, except in cases of gross negligence or willful misconduct as prohibited by law.
2.3 Release of Liability: To the fullest extent permitted by applicable law, you agree to release, waive, and forever discharge the Event Organizer, its owners, directors, officers, employees, agents, contractors, sponsors, vendors, insurers, affiliates, volunteers, and any other parties involved in the planning, organization, management, or operation of the Event (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, or expenses (including attorneys’ fees) arising out of or in connection with:
2.3.1. Injuries, illnesses, or damages sustained by you, your dependents, or your group during or because of the Event.
2.3.2. Any damage to or loss of personal property while attending the Event.
2.3.3. Any claims of negligence, ordinary or otherwise, on the part of the Released Parties in relation to the Event or its activities.
2.4 Acknowledgment of Equipment Risks: You acknowledge that equipment used in the Event activities (such as bouncy rides, games, or any other apparatus) may become unsafe due to improper use, unforeseen malfunctions, or wear and tear. You accept full responsibility for ensuring your safe use of such equipment and agree to follow all safety instructions provided by Event staff or signage.
2.5 Waiver of Claims for Third-Party Conduct: You understand and agree that the Released Parties are not responsible for the actions, omissions, or negligence of other Event participants, attendees, or third-party contractors. You waive any and all claims arising from injuries or damages caused by such third-party conduct.
2.6 Medical Treatment Acknowledgment: In the event of injury, illness, or emergency, you authorize the Event Organizer to arrange or provide emergency medical assistance at your own cost. You release the Organizer from any liability arising from the provision or non-provision of such medical care and agree to bear full responsibility for any medical expenses incurred.
2.7 No Warranty of Safety: You understand and acknowledge that the Organizer makes no guarantees or warranties, express or implied, regarding the safety of the Event, its premises, or its activities. Participation is at your own risk, and you assume full responsibility for your decisions and actions during the Event.
2.8 Indemnity for Misconduct: You agree that any failure to follow safety instructions, rules, or guidelines provided by the Organizer or Event staff may increase the risk of harm or injury. You assume full responsibility for the consequences of any misconduct or failure to follow such rules.
2.9 Parent/Guardian Acknowledgment for Minors
If you are attending the Event with a minor or dependents under your supervision, you:
2.9.1. Assume full responsibility for their safety and actions during the Event.
2.9.2. Acknowledge and accept all risks associated with their participation in the Event.
2.9.3. Release the Released Parties from liability for any claims or damages arising from the minor’s participation, as described in this Section.
2.10 Survival of Waiver: This Liability Waiver and Assumption of Risk shall survive the conclusion of the Event and shall remain enforceable beyond the termination or expiration of your ticket purchase or Event participation.
2.11 Severability of Waiver: If any part of this Liability Waiver is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
3. Participation Rules
3.1 General Conduct
- All participants must conduct themselves in a respectful, responsible, and lawful manner while attending the Event.
- All attendees must adhere to posted safety rules and instructions provided by Event staff or activity supervisors.
- Any behavior deemed disruptive, dangerous, or harmful to others, property, or the Event’s operations may result in immediate removal from the Event premises without a refund.
- All participants must meet the age, weight, and height restrictions posted for specific activities.
3.2 Compliance with Instructions: Participants are required to comply with all instructions, guidelines, and signage provided by the Event Organizer, staff, and security personnel. This includes, but is not limited to:
- Adhering to activity-specific safety guidelines (e.g., use of equipment or bouncy rides);
- Following queue management procedures and respecting staff directives to ensure a safe environment for all attendees.
- Complying with any emergency evacuation or safety protocols.
3.3 Supervision of Minors: Parents, guardians, or supervisors of minors are solely responsible for their safety and behavior during the Event. Minors must remain under direct supervision at all times and must adhere to all Event rules. Any failure to adequately supervise minors may result in removal from the Event.
3.4 Use of Equipment and Attractions: Participants must use all equipment, rides, games, and attractions in a safe and responsible manner. This includes:
- Following all posted rules and verbal instructions provided by Event staff.
- Participants who are under the influence of drugs or alcohol will not be permitted to engage in activities.
- Ensuring proper use of safety equipment, where applicable (e.g., helmets, harnesses);
- Not exceeding posted weight or height limits for rides or attractions.
- Not engaging in reckless behavior that endangers yourself, others, or the equipment.
Participants found misusing equipment or failing to follow safety instructions will be prohibited from further participation in activities and may be removed from the Event.
3.5 Health and Fitness Requirements: Participants are responsible for ensuring they are physically and medically fit to participate in Event activities. If you have a medical condition, illness, or injury that could be aggravated by participation, you are advised not to engage in any activities that may pose a risk to your health or safety. Certain activities may be restricted to individuals without pre-existing medical conditions, such as heart conditions, back injuries, or pregnancy.
3.6 Restricted Areas: Access to certain areas of the Event venue may be restricted to authorized personnel only. Participants are prohibited from entering restricted or staff-only areas. Any unauthorized entry may result in removal from the Event and, where applicable, legal action.
3.7 Assumption of Risk: By participating in any Event activities, you acknowledge and accept the risks associated with such participation as outlined in the “Assumption of Risk and Liability Waiver” section. Participants are advised to exercise caution and prioritize safety at all times.
3.8 Right of Refusal: The Organizer reserves the right to refuse entry or continued participation to anyone who fails to adhere to these rules, poses a risk to others, or engages in behavior that compromises the safety or enjoyment of the Event. Such individuals may be removed from the premises without refund.
3.9 Damages and Liability: Participants are responsible for any damages they cause to Event property, equipment, or facilities. The Organizer reserves the right to seek compensation for repair or replacement costs arising from misuse or intentional damage caused by participants.
3.10 Enforcement of Rules: The Organizer, along with Event staff and security personnel, retains the authority to enforce these Participation Rules. Participants who fail to comply with these rules may be subject to warnings, removal from the Event, and/or referral to law enforcement if necessary.
4. Parental/Guardian Consent for Minors
4.1 Parents or guardians purchasing tickets for minors must provide consent for their participation in Event activities.
4.2 Parents or guardians assume full responsibility for the safety and conduct of minors during the Event.
5. Indemnification and Hold Harmless Agreement
5.1. Comprehensive Indemnification: By purchasing a ticket and attending the Event, you (the “Participant”) agree to indemnify, defend, and hold harmless the Event Organizer, its owners, directors, officers, employees, agents, contractors, sponsors, vendors, insurers, affiliates, volunteers, and any other parties involved in the planning, organization, management, or operation of the Event (collectively, the “Indemnified Parties”) from and against any and all liabilities, claims, actions, suits, demands, damages, judgments, settlements, fines, penalties, losses, and expenses (including, but not limited to, reasonable attorneys’ fees, court costs, and investigative costs) arising from, related to, or in connection with:
5.1.1. Your participation in any activities at the Event, including but not limited to bouncy rides, games, or any other attractions, regardless of whether such activities are supervised or unsupervised.
5.1.2. Any injury, death, illness, or property damage suffered by you, your minor dependents, or any individuals in your group.
5.1.3. Your failure to adhere to Event rules, safety guidelines, or instructions provided by Event staff or contractors.
5.1.4. Any act, omission, misconduct, or negligence on your part or the part of any minors or dependents under your supervision.
5.1.5. Damage to Event property, facilities, equipment, or infrastructure caused by you or individuals in your group.
5.1.6. Any claims brought by third parties (e.g., other attendees, bystanders, vendors, or contractors) due to your actions, omissions, or negligence.
5.1.7. Any violation of local, state, or federal laws, regulations, or ordinances committed by you during the Event.
5.2. Indemnification for Third-Party Claims: This indemnification expressly applies to claims, damages, or losses brought by third parties, including but not limited to:
- Personal injury or property damage claims by third parties, including but not limited to other attendees, contractors, or bystanders and Event participants or attendees caused by your actions, negligence, or failure to follow safety protocols.
- Claims arising from the unauthorized use of restricted or prohibited items, such as sharp objects, alcohol, or contraband, brought into the Event by you or your dependents.
5.3. Broad Application of Indemnity: You agree that your indemnification obligations under this Section apply:
5.3.1 Regardless of whether the claims or damages arise, in part, from the negligence of the Indemnified Parties (except in cases of gross negligence or willful misconduct, as prohibited by law).
5.3.2 To all claims, whether they arise during the Event or afterward (including future claims and liabilities related to the Event).
5.3.3. To claims involving unforeseen, indirect, or incidental damages, whether foreseeable or unforeseeable.
5.4. Waiver of Subrogation and Recovery Rights: You expressly waive any right of recovery, subrogation, or reimbursement against the Indemnified Parties for claims or damages paid under any insurance policies you hold, including health, property, or liability insurance.
5.5. Assumption of Financial Responsibility: If the Organizer incurs any costs, damages, or expenses (including legal fees) due to your actions, omissions, or violations of these Terms, you agree to fully reimburse the Organizer within seven (7) calendar days of receiving a written demand for payment.
5.6. Group and Third-Party Responsibility: If you are purchasing tickets or granting Event access to other individuals (e.g., minors, family members, or a group), you agree to indemnify and hold harmless the Indemnified Parties for any claims, actions, damages, or expenses arising from the conduct, negligence, or participation of those individuals.
5.7. No Limitation of Liability for the Indemnified Parties: Nothing in this Agreement shall limit or exclude the Indemnified Parties’ protection from liability under applicable laws to the fullest extent permissible, including immunity from incidental or consequential damages.
5.8. Survival of Indemnity Obligations: The indemnification obligations outlined in this Section shall survive:
- The conclusion of the Event.
- The expiration of your ticket purchase.
- Any termination or modification of these Terms and Conditions.
5.9. Acknowledgment of Risk and Indemnity Obligations: You acknowledge and agree that participation in the Event involves inherent risks, including but not limited to physical injury, illness, death, property damage, or economic loss, and that you bear full responsibility for such risks. Your indemnity obligations extend to all risks associated with your participation in the Event, regardless of cause.
Force Majeure Indemnity
5.10. Force Majeure Events: You agree to indemnify and hold harmless the Indemnified Parties from any claims, damages, or losses resulting from delays, interruptions, or cancellations of the Event caused by events beyond the Organizer’s reasonable control, including but not limited to acts of God, pandemics, weather events, governmental restrictions, or other force majeure circumstances.
6. Medical Assistance
Participants acknowledge that participation in the Event and its activities may involve inherent risks of injury, illness, or other medical emergencies. The Organizer makes no guarantees regarding the availability of on-site medical personnel or the adequacy of emergency medical services provided at the Event.
6.1. In the event of an emergency, you authorize the Organizer to arrange for medical treatment and agree to cover the costs of such treatment. The Organizer is not responsible for providing medical care during the Event.
6.2. Consent to Medical Treatment: By attending the Event, you consent to receive or have administered to you, at your own cost, first aid, emergency medical treatment, or other medical services as deemed necessary by the Organizer, Event staff, or emergency medical personnel in the event of an injury, illness, or other medical emergency.
6.3. Responsibility for Medical Costs: You agree to bear full financial responsibility for any and all medical expenses incurred as a result of your attendance at the Event, including but not limited to:
• Ambulance transportation.
• Hospitalization.
• Medications.
• Follow-up care or rehabilitation services.
The Organizer and Released Parties will not be held responsible for any costs associated with medical treatment.
6.4. Release of Liability for Medical Services: You release and hold harmless the Organizer and the Released Parties from any liability related to the provision, delay, or lack of medical services at the Event. This includes, but is not limited to, claims arising from:
- The actions, omissions, or negligence of medical personnel;
- Delays in accessing emergency medical services;
- Inadequate or unavailable medical care.
6.5. Duty to Report Medical Conditions: Participants with pre-existing medical conditions, allergies, or other health concerns that could affect their ability to safely participate in the Event are required to inform Event staff or medical personnel upon arrival. Failure to disclose relevant health information may exacerbate the risk of injury or illness, for which the Organizer assumes no liability.
6.6. No Duty of Care for Pre-Existing Conditions: The Organizer assumes no responsibility for the exacerbation of pre-existing medical conditions during or after the Event. Participants are solely responsible for managing their own health and ensuring they are fit to participate in Event activities.
6.7. Emergency Contact Information: Participants are encouraged to provide accurate emergency contact information when purchasing tickets or upon entering the Event to the Event Organizer Booth/Information Booth. In the event of a medical emergency, the Organizer may contact the individual(s) listed, but the Organizer assumes no liability for failure to do so or for the timeliness of such contact.
6.8. Health and Fitness Certification: By participating in the Event, you certify that you are physically and medically capable of participating in the activities offered. You further certify that you are not under the influence of alcohol, drugs, or any substance that could impair your ability to safely engage in Event activities.
6.9. Severability of Medical Assistance Clause: If any part of this Medical Assistance section is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
7. Prohibited Items, Activities and Behavior: To ensure a safe and enjoyable environment for all attendees, the following items and activities are strictly prohibited at the Event.
7.1. Weapons and Dangerous Items
- Firearms, ammunition, explosives, or any other weapon, regardless of whether the owner has a permit.
- Knives, sharp objects, or any tool or item that could be used as a weapon.
- Fireworks, flares, or any other incendiary devices.
7.2. Illegal Substances and Controlled Items
- Illegal drugs or controlled substances, including paraphernalia related to their use.
- Prescription medications without proper documentation or in amounts exceeding personal use.
7.3. Alcohol and Intoxicants
- Alcoholic beverages, unless explicitly authorized by the Organizer in designated areas.
- Substances that impair cognitive or physical abilities, including over-the-counter drugs used for recreational purposes.
7.4. Hazardous Materials
- Toxic, flammable, or corrosive substances.
- Pressurized containers such as gas canisters, except for medical devices like portable oxygen tanks.
- Drones, remote-controlled devices, or other items that may pose a risk to safety when used improperly.
7.5. Glass and Fragile Items
- Glass bottles, containers, or objects that can shatter and pose a safety risk.
7.6. Unauthorized Sales or Solicitation
- Unauthorized vending, promotional distribution, or solicitation of any kind.
- Counterfeit goods, fake tickets, or items intended for resale without authorization from the Organizer.
7.7. Offensive or Distracting Items
- Signs, banners, flags, or apparel displaying offensive language, symbols, or imagery.
- Lasers, strobe lights, or devices that could distract or cause harm to others.
7.8. Pets and Animals
- Animals, except for registered service animals, are prohibited. Attendees with service animals may be required to provide documentation.
7.9. Banned Activities
- Smoking, vaping, or the use of tobacco products outside designated areas.
- Excessively loud music, shouting, or behavior that disrupts the enjoyment of other attendees.
- Running, pushing, or other reckless actions in crowded areas.
7.10. Recreational Equipment
- Bikes, skateboards, scooters, rollerblades, or similar recreational devices, unless explicitly authorized for use in designated areas.
- Unauthorized use of drones or aerial devices over the Event premises.
7.11. Environmental Hazards
- Items that could damage or deface the Event venue, such as markers, paint, or adhesives.
- Confetti, glitter, or other materials that are difficult to clean and harmful to the environment.
7.12. Other Restricted Items
- Personal generators, large battery packs, or portable power supplies not approved by the Organizer.
- Coolers, large bags, or oversized items that obstruct pathways or create safety concerns.
7.13. Enforcement of Prohibited Items and Activities: The Event Organizer reserves the right to inspect bags, belongings, and vehicles upon entry and at any time during the Event. Any prohibited items discovered will be confiscated, and attendees found in possession of such items may be denied entry or removed from the Event premises without refund.
- Attendees are expected to behave in a respectful and safe manner toward staff and other participants. Climbing on inflatable structures or equipment in an unsafe manner is strictly prohibited.
- Disruptive or dangerous behavior will result in removal from the Event without a refund.
- Damage to Event property, equipment, or facilities caused by attendees will be the financial responsibility of the attendee.
8. Photography and Media Release
8.1. By attending the Event, you grant the Organizer permission to capture and use photos or videos of the Event for promotional purposes.
8.2. If you wish to opt out, you must notify the Organizer in writing before attending.
9. Refund Policy
9.1. All ticket sales are final. Refunds will only be issued if the Event is canceled by the Organizer.
10. Ticket Terms
10.1. Tickets are non-refundable and non-transferable, except in the case of Event cancellation.
10.2. Tickets must be presented at the Event entrance, either as a printed copy or on a mobile device. Lost or stolen tickets will not be reissued.
11. Event Cancellation or Rescheduling
11.1. The Organizer reserves the right to cancel or reschedule the Event due to unforeseen circumstances, including weather conditions, safety concerns, or other force majeure events.
11.2. In the event of cancellation, ticket holders will be offered refunds or the option to attend the rescheduled Event.
12. Force Majeure
12.1. The Organizer is not liable for any cancellations, delays, or interruptions caused by events outside its control, including acts of God, pandemics, natural disasters, or government restrictions.
13. Personal Belongings
13.1. Responsibility for Belongings: Participants are solely responsible for their personal belongings while attending the Event. The Event Organizer assumes no liability for lost, stolen, or damaged items brought to the Event premises, regardless of the circumstances.
13.2. Recommended Safeguards: To minimize the risk of loss or theft, participants are strongly encouraged to:
- Keep valuables, such as wallets, phones, and jewelry, secured at all times.
- Avoid leaving personal items unattended in crowded or public areas.
13.3. Prohibited Items of Value: Participants are advised not to bring large amounts of cash, expensive jewelry, or high-value items (e.g., electronics or collectibles) to the Event. The Event Organizer will not provide compensation for any loss of such items.
13.4. Lost and Found: The Event Organizer will maintain a Lost and Found area at the Event venue.
- Participants are encouraged to report lost or found items immediately to Event staff.
- The Organizer will hold lost items for a limited period following the Event. Unclaimed items may be donated, discarded, or handled at the Organizer’s discretion.
